Learning Objectives: 

Under the current system, CBSA officers may detain individuals if there are grounds to believe they are unlikely to appear for an immigration proceeding, including removal, if they pose a danger to the public or if their identity is in question.

The use of detention occurs more likely for certain failed asylum claimants as well as person(s) out of status in Canada, when the risk of flight is high and there are no reasonable alternatives to mitigate that risk.

Currently, asylum claimants who have received a negative decision and have exhausted all other processes are given a time-limited opportunity to leave Canada prior to the CBSA taking action to enforce their removal orders.

They may be removed from Canada to their home country or to the country they entered from to Canada. They may also choose the option to leave voluntarily.

Detention hearings and removal proceedings involve complex procedures and rules. Detainees are highly recommended to seek counsel assistance in such situations.

Lawyers and RCICs are equally authorised to represent clients under given situations.

This course may assist legal professionals and attendees to understand the overview of the process and make a wise decision based on case-to-case assessment.
