Negative decisions made by CIC are either appealable before board or federal courts in Canada. Grounds for appeal are mostly based on procedural error(s) made by decision maker during examination process.
Immigration operational manuals, procedures and bulletins are not part of the legislation or act and are not for clients or legal professionals/practitioners to follow, but still carry key value when files are assessed and examined by decision makers. Decision makers follow these procedures to reach final decision and/or to communicate with client or counsel or any other third party during file examination.
This class will assist attendees to understand the legality of these procedures and how they are applied during the decision making process. Attendees will also learn how to analyse their case files in the light of these procedural manuals and be proactive for the best interest of client.
